เนื่องด้วยบริษัท กัลฟ์ เอ็นเนอร์จี ดีเวลลอปเมนท์ จำกัด (มหาชน) และบริษัทในเครือ (“บริษัทฯ”) ได้จัดให้มีการติดตั้งกล้องวงจรปิดภายใน และบริเวณโดยรอบสถานที่ของบริษัทฯ เพื่อการรักษาความมั่นคง และปลอดภัยของสถานที่ ทรัพย์สิน พนักงาน ลูกค้า และผู้มาติดต่อของบริษัทฯ ดังนั้น ทางบริษัทฯ จึงจัดให้มีมาตรการคุ้มครองข้อมูลส่วนบุคคลที่บริษัทฯ ได้รับมาจากการใช้กล้องวงจรปิดดังกล่าว ซึ่งมีรายละเอียดปรากฏตามประกาศฉบับนี้ เพื่อให้ท่านมั่นใจว่าบริษัทฯ จะให้ความคุ้มครองและปฏิบัติต่อข้อมูลส่วนบุคคลของท่านโดยสอดคล้องกับพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ที่บังคับใช้ ซึ่งบริษัทฯ อาจดำเนินการปรับปรุงประกาศฉบับนี้เป็นครั้งคราว โดยท่านสามารถพบประกาศฉบับปรับปรุงของบริษัทฯ ได้ที่

Gulf Energy Development Public Company Limited and our affiliated companies (“we”, “us”, or “our”) are using closed-circuit television (CCTV) devices for monitoring our designated areas within and around our buildings and facilities for the security and safety of our premises, assets, staff, customers and visitors. We therefore establish measures for protection of your personal data received from our use of CCTV as detailed below in order to enhance your confident that we will protect and manage your personal data in accordance with the Personal Data Protection Act B.E 2562. We may update this notice from time to time. You can find our updated notice at

ข้อมูลส่วนบุคคลที่ถูกเก็บรวบรวม
Types of Personal Data We Collected

กล้องวงจรปิดของบริษัทฯ จะบันทึกภาพถ่าย และ/หรือภาพวีดีโอของบุคคลทุกคน รวมทั้งทรัพย์สินของบุคคลเหล่านั้น (เช่น ยานพาหนะ) ซึ่งเข้ามาในพื้นที่ภายใต้การสอดส่องดูแลที่อยู่ภายใน หรือโดยรอบสถานที่และสิ่งอำนวยความสะดวกของบริษัทฯ

Our CCTV captures moving or still images of all individuals and their belongings (e.g. vehicles) when entering the monitored area in or around our premises and facilities.

วัตถุประสงค์ของการประมวลผลข้อมูลส่วนบุคคล
How We Process your Personal Data

2.1

บริษัทฯ มีความจำเป็นต้องเก็บรวบรวม ประมวลผล และ/หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน เพื่อวัตถุประสงค์ดังต่อไปนี้
We may collect, use, disclose, or process your personal data, for the following purposes:

(ก)

การคุ้มครองชีวิต ร่างกาย สุขภาพ ความปลอดภัยส่วนบุคคล และทรัพย์สินของบุคคลต่างๆ

(a)

to protect your health and personal safety, including your belongings

(ข)

การคุ้มครองและป้องกันสถานที่ สิ่งอำนวยความสะดวก และสินทรัพย์ของบริษัทจากความเสียหาย การถูกรบกวน การทำลาย และอาชญากรรมอื่นๆ

(b)

to protect and prevent our premises, facilities and assets from damage, disruption, vandalism, and other crime;

(ค)

การสนับสนุนหน่วยงานบังคับใช้กฎหมายในการป้องกัน สืบสวน และดำเนินคดีต่ออาชญากรรม และการดำเนินการเพื่อการยับยั้งอาชญากรรม

(c)

to support law enforcement organizations in the prevention, detection, and prosecution of crime and to act as a deterrent against crime;

(ง)

การช่วยเหลือในการระงับข้อพิพาทอย่างมีประสิทธิภาพ ตามที่เกิดขึ้นในกระบวนการทางวินัยหรือการร้องทุกข์

(d)

to assist in the effective resolution of disputes which arise in the course of disciplinary or grievance proceedings;

to assist in the investigation or proceedings concerning a whistleblowing complaint; and loment proceedings

2.2

กล้องวงจรปิดของบริษัทฯ ทำงานตลอดยี่สิบสี่ชั่วโมง เว้นแต่ในกรณีที่ระบบขัดข้องหรือมีการซ่อมบำรุงระบบ
Our CCTV is in operation 24 hours a day, except in case of system failure or maintenance.

2.3

บริษัทฯ ได้ติดตั้งป้ายที่เหมาะสมไว้ในพื้นที่ภายใต้การสอดส่องดูแล เพื่อแจ้งให้ท่านทราบถึงการใช้กล้องวงจรปิด และการบันทึกข้อมูลส่วนบุคคลของท่าน
We place appropriate signage in the monitored areas to alert you that a CCTV installation is in use and your personal data is recorded.

หลักเกณฑ์หรือฐานทางกฎหมาย
LEGAL BASIS

บริษัทฯ อาจเก็บรวบรวม เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลองท่าน โดยอาศัยหลักเกณฑ์หรือฐานทางกฎหมาย ดังต่อไปนี้
We may collect, use, disclose, or process your personal data on any of the following legal basis;

(ก)

ฐานประโยชน์สำคัญต่อชีวิต การเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลนั้นเป็นการจำเป็น เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล

(a)

Vital interest. The collection, use, disclosure, or processing is necessary for the prevention or suppression of a danger to a person's life, body, or health.

(ข)

ฐานประโยชน์อันชอบด้วยกฎหมาย การเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลของท่านเป็นการดำเนินการเพื่อประโยชน์อันชอบด้วยกฎหมายของบริษัทฯ เพื่อบรรลุวัตถุประสงค์อย่างใดอย่างหนึ่งตามที่ระบุข้างต้น

(b)

Legitimate interest. It is in our legitimate interest to collect, use, disclose, or process, your personal data to achieve any of the purposes described above.

(ค)

ฐานหน้าที่ตามกฎหมาย บริษัทฯ มีหน้าที่ต้องปฏิบัติตามภาระผูกพันตามที่กำหนดไว้โดยกฎหมายที่ใช้บังคับ ซึ่งรวมถึง แต่ไม่จำกัดเพียง กฎหมายว่าด้วยความปลอดภัยและสิ่งแวดล้อมในสถานที่ทำงาน บริษัทฯ ถือว่าการใช้กล้องวงจรปิดเป็นมาตรการที่สำคัญซึ่งช่วยให้บริษัทฯ สามารถปฏิบัติตามภาระผูกพันเหล่านี้ได้

(c)

Legal obligations. We owe a duty to comply with the legal obligations prescribed by the applicable laws, including but not limited to the laws regarding safety and environment in the workplace. We consider the use of CCTV as a necessary measure to enable us to meet those obligations. above.

DISCLOSURE OF YOUR PERSONAL DATA TO THIRD PARTIES

4.1

บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อบุคคลที่สาม (รวมถึงบริษัทในเครือ และผู้ให้บริการของบริษัทฯ) ในกรณีที่บริษัทฯ พิจารณาว่ามีความจำเป็นต้องเปิดเผยข้อมูลส่วนบุคคลนั้นเพื่อวัตถุประสงค์ตามที่ระบุข้างต้น
We may disclose your personal data to third parties (including our affiliates and service providers) if we consider that the disclosure is necessary for the purposes described above.

4.2

บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อหน่วยงานบังคับใช้กฎหมาย หากมีความจำเป็นต้องเปิดเผยเพื่อการปฏิบัติหน้าที่ตามกฎหมายของบริษัทฯ และเพื่อสนับสนุน หรือช่วยเหลือหน่วยงานบังคับใช้กฎหมายในการป้องกันสืบสวน และดำเนินคดีต่ออาชญากรรม
We may disclose your personal data to law enforcement agencies if the disclosure is necessary for compliance with our legal obligations and to support or assist them in the prevention, detection, and prosecution of crime.

ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล
PERIOD OF RETENTION

5.1

บริษัทฯ อาจเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้ไม่เกินกว่าระยะเวลาเท่าที่จำเป็นเพื่อการบรรลุวัตถุประสงค์ตามที่ระบุในประกาศฉบับนี้ หรือเท่าที่จำเป็นตามกฎหมายที่ใช้บังคับ ทั้งนี้ บริษัทฯ อาจจำเป็นต้องเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นเพื่อการจัดการข้อพิพาทหรือกระบวนการทางกฎหมายซึ่งอาจเกิดขึ้น
We may retain your personal data no longer than as is necessary to achieve the purposes described in this notice or as is required by applicable laws. We may need to retain your personal data for so long as is necessary to deal with any disputes or legal proceedings that may arise.

5.2

ถ้าบริษัทฯ หมดความจำเป็นในการเก็บรักษาข้อมูลส่วนบุคคลของท่าน บริษัทฯ อาจทำลาย ลบ นำออกจากระบบ หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลได้
If we no longer need to retain your personal data, we may destroy, delete, remove or anonymize your personal data.

สิทธิของเจ้าของข้อมูลส่วนบุคคล
RIGHTS OF DATA SUBJECT

ภายใต้หลักเกณฑ์ที่กำหนดไว้ในพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ท่านในฐานะเจ้าของข้อมูลส่วนบุคคลมีสิทธิดำเนินการต่างๆ ดังต่อไปนี้
You, as the data subject shall have the following rights as prescribed under the Personal Data Protection Act B.E 2562;

(ก)

สิทธิการขอเข้าถึง ท่านมีสิทธิเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน หรือขอให้มีการเปิดเผยข้อมูลส่วนบุคคลของท่าน บริษัทฯ อาจปฏิเสธที่จะปฏิบัติตามคำขอของท่านได้ ในกรณีที่คำขอนั้นอาจมีผลกระทบต่อสิทธิและเสรีภาพของบุคคลอื่น ทั้งนี้เพียงเท่าที่ได้รับอนุญาตโดยกฎหมาย หรือคำสั่งศาล

(a)

Right to Access. You have the right to access and obtain a copy of your personal data or request to disclose your personal data. We may, to the extent permitted by law or a court order, refuse to act on your request where such request could affect the rights and freedom of another person. above.

(ข)

สิทธิการขอให้แก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง ท่านมีสิทธิขอให้มีการดำเนินการแก้ไขข้อมูลส่วนบุคคลซึ่งบริษัทฯ ได้ประมวลผลเกี่ยวกับท่านให้สมบูรณ์ ถูกต้อง ไม่ก่อให้เกิดความเข้าใจผิด หรือเป็นปัจจุบัน

(b)

Right to Rectification. You have the right to have incomplete, inaccurate, misleading, or not up-to-date personal data that we process about you rectified. above.

(ค)

สิทธิการคัดค้าน ท่านมีสิทธิคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน ซึ่งมีวัตถุประสงค์เพื่อการบรรลุประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ (หรือของบุคคลอื่น) ได้ บริษัทฯ อาจปฏิเสธที่จะปฏิบัติตามคำขอของท่าน ในกรณีที่บริษัทฯ สามารถแสดงได้ว่ามีเหตุอันชอบด้วยกฎหมายในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลดังกล่าวซึ่งอาจสำคัญยิ่งกว่าประโยชน์ของท่าน หรือถ้าการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลดังกล่าวเป็นไปเพื่อก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย

(c)

Right to Object. You have the right to object to the collection, use, or disclosure of your personal data for the purposes of achieving our legitimate interest (or that of other persons). We may refuse to comply with your request if we can demonstrate compelling legitimate grounds for such collection, use, or disclosure, which may override your own interests or if such collection, use, or disclosure is for the purposes of establishment, compliance, exercise or defense of legal claims.

(ง)

สิทธิการลบหรือทำลายข้อมูล ท่านมีสิทธิขอให้บริษัทฯ ดำเนินการลบ หรือทำลายข้อมูลส่วนบุคคลของท่าน หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลได้ หากท่านเชื่อว่า (1) ข้อมูลส่วนบุคคลนั้นหมดความจำเป็นสำหรับวัตถุประสงค์ที่ระบุในประกาศฉบับนี้แล้ว หรือ (2) ข้อมูลส่วนบุคคลของท่านได้ถูกเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมาย ทั้งนี้ บริษัทฯ อาจปฏิเสธที่จะปฏิบัติตามคำขอให้ลบ หรือทำลายข้อมูลส่วนบุคคลของท่านได้ เพื่อการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย การยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย หรือการปฏิบัติตามกฎหมาย

(d)

Right to Erasure. You have the right to request us to erase or destroy your personal data or to anonymize your personal data if you believe that (i) the personal data is no longer needed for the purposes described in this notice or (ii) the collection, use, or disclosure of your personal data is unlawful. We may refuse to comply with your request for erasure or destroy for the purposes of establishment, compliance, exercise or defense of legal claims, or compliance with laws.

สิทธิการขอให้ส่งหรือโอนย้ายข้อมูลส่วนบุคคล ท่านอาจมีสิทธิขอรับข้อมูลส่วนบุคคลของท่านที่บริษัทฯ มีอยู่ในรูปแบบอิเล็กทรอนิกส์ที่มีการจัดเรียงแล้ว และส่งข้อมูลส่วนบุคคลนั้นไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น โดยต้องเป็น (ก) ข้อมูลส่วนบุคคลที่ท่านได้ให้กับบริษัทฯ และ (ข) กรณีที่บริษัทฯ ประมวลผลข้อมูลนั้นโดยอาศัยฐานความยินยอมจากท่าน

(e)

Right to Data Portability. You may have the right to obtain your personal data we hold, in a structured, electronic format, and transmit such data to another data controller, where this is (a) personal information which you have provided to us, and (b) if we are processing that data on the basis of your consent.

สิทธิการจำกัดการประมวลผล ท่านมีสิทธิขอให้บริษัทฯ ระงับการใช้ข้อมูลส่วนบุคคลของท่านหากท่านเชื่อว่าบริษัทฯ หมดความจำเป็นในการเก็บรักษาข้อมูลส่วนบุคคลนั้นเพื่อวัตถุประสงค์ตามที่ระบุในประกาศฉบับนี้แล้ว แต่ท่านยังต้องการให้เก็บรักษาข้อมูลส่วนบุคคลนั้นไว้เพื่อการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย การยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย หรือการปฏิบัติตามกฎหมาย

(f)

Right to Restrict Processing. You have the right to request us to suspend the use of your personal data if you believe that we no longer need to retain the personal data for the purposes described in this notice, but you still require the retention for the purposes of establishment, compliance, exercise or defense of legal claims, or compliance with laws.

(ช)

สิทธิการถอนความยินยอม ในกรณีที่ท่านได้ยินยอมให้บริษัทฯ เก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน ท่านมีสิทธิที่จะถอนความยินยอมนั้น ณ เวลาใดก็ได้

Right to Withdraw Consent. . If you have consented to our collection, use, or disclosure of your personal data, you have the right to withdraw that consent at any time.

(ซ)

สิทธิการยื่นเรื่องร้องเรียน ท่านมีสิทธิยื่นเรื่องร้องเรียนบริษัทฯ ต่อหน่วยงานกำกับดูแลการคุ้มครองข้อมูลส่วนบุคคลได้ หากท่านเชื่อว่าบริษัทฯ ฝ่าฝืนหรือไม่ปฏิบัติตามหน้าที่ใดๆ ของบริษัทฯ ตามกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลที่ใช้บังคับ อย่างไรก็ตาม บริษัทฯ มีความยินดีเป็นอย่างยิ่งที่จะแก้ไขเรื่องร้องเรียนของท่านเป็นลำดับแรกก่อนหน่วยงานกำกับดูแลดังกล่าว จึงขอให้ท่านโปรดดำเนินการติดต่อทางบริษัทฯ เสียก่อน

Right to Lodge a Complaint. You have the right to file a complaint against us to the relevant data protection supervisory authority if you believe that we breach or do not comply with any of our obligations under the applicable personal data protection laws. We would, however, appreciate the chance to deal with your concerns before you approach the competent authority, so please contact us in the first instance.

หากท่านประสงค์จะใช้สิทธิของเจ้าของข้อมูลส่วนบุคคลข้างต้น ท่านสามารถขอใช้สิทธิดังกล่าวต่อบริษัทฯ ได้โดยการดาวน์โหลดแบบคำร้องขอใช้สิทธิตามลิ้งค์ที่ปรากฏนี้ Data Subject Rights Request Form และนำส่งแบบคำร้องที่กรอกข้อมูลครบถ้วนให้แก่บริษัทฯ มายังช่องทางการติดต่อที่ระบุไว้ในประกาศฉบับนี้
